Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and APPJS Technologies Private Limited ("we", "us", "our"), which operates MarktMakrs (the "Service"). By signing in to or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

2. Who may use the Service

You must be at least 18 years old and legally able to enter into this agreement. You sign in with a Google account, and your access is personal to you — do not share it, and do not let anyone else sign in as you. We may refuse, restrict, or withdraw access at any time, as set out below.

3. Your account

Signing in with Google for the first time creates an account for you. There is nothing to fill in and no password for you to manage — Google authenticates you, and we keep only the short record described in our Privacy Policy.

Keep your Google account secure: anyone who can sign in as you can use the Service as you. If you believe someone else has used your access, tell us promptly at support@marktmakrs.in. You may ask us to close your account at the same address at any time, and you may stop using the Service simply by signing out.

Closing your account does not by itself refund a subscription you have already paid for. What is refundable, and when, is set out in the Refund & Cancellation Policy.

4. What the Service is

The Service is a dashboard that applies technical analysis to market data. It computes indicators and pattern scans — moving-average crossovers, momentum measures, breakouts, gaps, candle patterns, market structure, support and resistance, and similar — across a selected universe of listed instruments, and presents the results in tables and charts.

What the Service produces is the output of formulas applied to historical data. A row appearing in a scan means a numerical condition was met. It is not a suggestion to buy, sell, or hold anything.

5. Plans, payment and billing

The Service requires a paid subscription, monthly or yearly, after a 7-day free trial that starts the first time you sign in. The trial takes no payment and does not turn into a paid subscription by itself. What each plan costs is set out on our Pricing page. Prices are shown in Indian rupees and state whether they include GST.

Payments are processed by PhonePe. You enter your payment details on their page, not ours — we never see or store your card, UPI or bank details. We receive only confirmation that a payment succeeded, its amount, and which account it belongs to.

A paid subscription renews automatically at the end of each billing period, at the price then shown on the Pricing page, until you cancel it. Cancelling stops the next renewal; it does not end your current period early.

We may change prices. If we do, we will give you notice before the change takes effect, and the new price applies only from your next billing period. If you do not want to continue at the new price, cancel before that period begins.

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. It sets out how to cancel, what can be refunded, and how long a refund takes. If a payment is taken in error or a subscription fails to activate, write to support@marktmakrs.in with the transaction ID.

You are responsible for any taxes that apply to you beyond those stated at checkout.

6. Not investment advice

This is the most important term in this document. Please read it.

• We are not an investment adviser, research analyst, portfolio manager, or stockbroker, and we are not registered as any of these. Nothing in the Service is investment advice, research, or a recommendation, and nothing in it is tailored to your financial situation, objectives, or risk tolerance.
• Indicators, signals, scores, and chart annotations are computational outputs, not opinions about what you should do. No signal predicts a future price.
• Every trading and investment decision you make is entirely your own. You are responsible for your own due diligence, and for any profit or loss that results.
• Trading in securities and derivatives carries risk, including the risk of losing your entire capital. Past performance of any pattern or strategy does not indicate future results.
• Consider taking advice from a licensed financial adviser who knows your circumstances before acting on anything you see here.

7. Market data and accuracy

Market data reaches the Service from third-party sources, including Zerodha Kite Connect. It may be delayed, incomplete, adjusted, corrected after the fact, or simply wrong, and the Service may be unavailable when those sources are. Computed values also depend on the parameters and data windows used and can differ from other platforms.

We do not warrant that any price, indicator, signal, or scan result is accurate, current, or complete, and you should verify anything you intend to act on against your broker or another authoritative source.

8. Acceptable use

You agree not to:

• share your access, credentials, or session with anyone else, or sign in as someone other than yourself;
• scrape, bulk-download, resell, redistribute, or publicly republish market data or scan output obtained from the Service;
• use automated means to place unreasonable load on the Service, or attempt to circumvent rate limits, authentication, or any access restriction;
• reverse-engineer, decompile, or attempt to extract source code or credentials from the Service, or probe it for vulnerabilities without our written permission;
• interfere with the Service's operation or security, or use it for anything unlawful, including market manipulation or trading on unpublished price-sensitive information.

9. Third-party services

Signing in uses Google Identity Services, and market data comes via Zerodha Kite Connect. Your use of those services is governed by their own terms and policies, which we do not control. We are not responsible for their availability, accuracy, or conduct.

10. Intellectual property

The Service — its software, design, text, and the particular way it computes and presents signals — belongs to APPJS Technologies Private Limited and is protected by law. These Terms grant you a limited, revocable, non-transferable permission to use the Service for your own purposes, and nothing more. Underlying market data remains the property of its respective owners.

11. Availability and changes

The Service is provided on an as-available basis. We may change, suspend, add to, or discontinue any part of it, including individual scans, at any time and without notice. We do not promise any particular uptime, and maintenance, data-provider outages, or market holidays may interrupt it.

12. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any result obtained from it will be reliable or profitable.

13. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any trading or investment loss, lost profit, lost opportunity, loss of data, or any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service — including any reliance on a signal, indicator, chart, or scan result, and including data that turns out to be inaccurate, delayed, or unavailable.

Where liability cannot lawfully be excluded, our total aggregate liability arising out of or relating to the Service is limited to the amount you have paid us for it in the twelve months before the claim, or, where you have paid nothing, to one thousand Indian rupees (₹1,000).

14. Indemnity

You agree to indemnify and hold us harmless against any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your trading or investment decisions, or your breach of these Terms.

15. Suspension and termination

We may remove or restrict your access at any time, with or without notice, including if we believe these Terms have been breached or if we stop offering the Service. We may do this by disabling your account rather than deleting it. You may stop using the Service at any time by signing out, and you may ask us to delete your account and the record we hold with it — see our Privacy Policy for what that record contains and what deletion removes.

If we withdraw a paid subscription for a reason other than your breach of these Terms — for example because we stop offering the Service — we refund the unused part of the period you have paid for. If we terminate it because these Terms were breached, we do not. Closing your own account is covered by the Refund & Cancellation Policy.

Terms that by their nature should survive termination — disclaimers, limitation of liability, indemnity, intellectual property, and governing law — continue to apply after it.

16. Changes to these terms

We may update these Terms. When we do, we will change the date at the top of this page. Continuing to use the Service after an update means you accept the revised Terms.

17. Privacy

Our Privacy Policy explains what personal data we handle and why, and forms part of these Terms.

18. Governing law and contact

These Terms are governed by the laws of India, and you and we submit to the exclusive jurisdiction of the competent courts in India. Questions about these Terms, and any legal notice, may be sent to support@marktmakrs.in.
